MAN SENTENCED TO LIFE FOR RAPE OF A MINOR

The Bloemfontein Sexual Offences Court has sentenced a 49-year-old man to life imprisonment after he was found guilty of raping a 4-year-old minor. Magistrate Jan Greyvensteyn sentenced Zakhonze Dasheka for raping a minor on Christmas Day in 2019 in Freedom Square.

On the day of the incident, Dasheka, who was renting a back room at the residence of the complainant’s grandmother, came home with new clothes and told the complainant that he bought her clothes for Christmas, and she must come to his room to fit them. The complainant went to Dasheka’s room and that’s when he raped her. She went to her grandmother who was sleeping in the main house, woke her up and told her of what Dasheka did to her. The complainant was taken to the National Hospital for examination and a case was reported to the police. Dasheka was arrested later that day.

Dasheka pleaded guilty and requested the court, through his lawyer, to deviate from the minimum prescribed sentence because he saved court time by pleading guilty. However, the State Prosecutor, Advocate Ronell Botha requested the court not to deviate from the minimum sentence as prescribed by law because Dasheka is only pleading guilty because he is aware that the state has overwhelming evidence against him.

“The accused is pleading guilty, not because he is remorseful but because he is aware that the state has overwhelming evidence against him, and the intention of his guilty plea is just to get a lenient sentence. I request the court not to deviate from the minimum prescribed sentence for flimsy reasons because there are no substantial and compelling circumstances advanced by the accused justifying deviation from the minimum sentence” said Botha.

Botha further presented the victim impact statement facilitated by court preparation officer, Maggie Faas in which the grandmother of the complainant stated that the incident had a negative impact on the complainant because she no longer plays with other children like she used to.

In sentencing the accused, Magistrate Greyvensteyn said that the accused, though he was not a family member, was in a position of trust and the little girl trusted him but he betrayed the trust she had in him. He then sentenced Dasheka to life imprisonment and ordered that his name should be included in the National Register for Sexual Offenders.
