THREE MEN WERE SENTENCED TO 18 YEARS FOR ROBBING A TOBACCO TRUCK

Three men, Hendrick Zukazi (50), Nbazima Frans Mashavha (38), and Bernard Dumisani Jala (52), from Tembisa, Mokopane, and Olievenhoutbosch were convicted and sentenced by the Mokopane Regional Court, to 18 years imprisonment for robbery with aggravating circumstances and six years imprisonment for attempted murder. The accused persons robbed the British American Tobacco delivery vehicle, full of cigarettes, and shot and wounded two occupants.

The truck was delivering cigarettes around the Waterberg district, and it stopped at a certain tuck shop in Mahwelereng where the incident took place on 15 October 2020. The accused were arrested with the help of Hendrick De Vos, of Waterberg neighborhood watch security, in collaboration with Mokopane SAPS. During the trial, the accused persons pleaded not guilty.

In aggravation of sentence, the state Adv. Moses Mohale has submitted that these offences are prevalent within the jurisdiction and that the complainant has suffered loss, as the cigarettes were never recovered. The accused persons proceeded to shoot the witnesses even though there was no resistance from them and one of the witnesses is no longer fit to work due to injuries. All the accused persons have previous convictions, and those sentences never deterred them from committing crimes again. The state advocate then argued that there are no substantial or compelling circumstances for the court to deviate from the prescribed minimum sentence.

The NPA welcomes the sentence and hopes that this sentence will deter other would-be offenders from committing such crimes. We are pleased with the good work done by Adv. Mohale and investigating officer, Captain Ishmael Mogotlane of Polokwane Organised Crime.
