CONVICTIONS IN JULY UNREST MATTER

The matter of S v Dylan and Ned Govender appeared before the Durban High Court today for judgment. The brothers were charged with murder and three counts of attempted murder that took place in July 2021, in the Phoenix area. This was during the looting and public violence that occurred in various parts of KwaZulu-Natal. They were charged accordingly for the following: the murder of Mondli Majola, the attempted murder of Nkululeko Mangwe, the attempted murder of Mxolisi Putuzo, and the attempted murder of Qaphelani Mkovu.

In handing down the judgment, the court found that there was insufficient evidence to sustain the charge of murder against them and convicted them of assault GBH. The court also found that there was insufficient evidence to convict them of the attempted murder of Mangwe, and they were thus convicted of assault common. They were convicted for the attempted murder of Putuzo and acquitted of the attempted murder of Mkovu.

The matter was remanded to 05 July 2023, for sentencing and the court extended their bail of R15 000 each.
