YOUNG MAN SENTENCED TO 18 YEARS’ IMPRISONMENT FOR MURDER
Limpopo, South Africa – The Polokwane Regional Court has convicted and sentenced Kholofelo Maimela, from Extension 71 in Polokwane, to 18 years’ imprisonment for murder and assault with intent to do grievous bodily harm (GBH). The accused had pleaded not guilty; however, the State led compelling evidence from witnesses who confirmed that the accused, the deceased, and the surviving victim were known to each other as they lived in the same area.
On 31 October 2022, the deceased, Eddie and Mokami, and the surviving victim went to a nearby tavern in Extension 71. While drinking, the accused provoked the deceased by mocking him for not having money. After the tavern closed, the deceased and the victim walked outside, where the accused followed them. He stabbed the deceased once in the neck, killing him instantly, and proceeded to stab the victim on the chest and in the eye. The incident was reported to the police, and the accused was arrested shortly thereafter.
During sentencing proceedings, State Prosecutor Vhodzulaho Mukosi argued that the accused acted violently by attacking two unarmed individuals with a knife. She submitted that the deceased’s right to life was unlawfully taken away and that the accused showed no remorse, maintaining his innocence throughout the trial. The State further argued that no substantial and compelling circumstances existed for the court to deviate from the prescribed minimum sentence.
Regional Court Magistrate Felleng Ntilane concurred with the State, emphasising that a young life was lost and the surviving victim’s dignity was violated as now he lives with permanent scars on his chest and eye. The magistrate found that the accused acted in an inhumane, degrading, and cruel manner over a flimsy provocation. The court concluded that there were no substantial and compelling circumstances warranting a lesser sentence.
The National Prosecuting Authority (NPA) welcomes the sentence. The Director of Public Prosecutions, Adv. Ivy Thenga reiterated that human life is precious and that perpetrators who commit violent crimes must face long-term imprisonment. She commended the excellent work of Prosecutor Mukosi and Investigating Officer Sergeant Baloyi of the Westenburg Police Station.
